Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the ProdEnhancer website, applications and services (the "Service"). The Service is provided by ProdEnhancer ("ProdEnhancer", "we", "us", "our"), and by using the Service you are entering into an agreement with ProdEnhancer.

1. Acceptance of these Terms

By creating an account, purchasing a subscription, or otherwise continuing to use the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company or organisation, you confirm that you have authority to bind that organisation. If you are using it as an individual, you confirm that you are of legal age to form a binding contract.

2. The Service

ProdEnhancer provides industrial engineering tooling for garment and sewing manufacturing, including time study and standard-time analysis (GSD, PMTS, MTM-2, MOST), line balancing, layout planning, LEAN and Kanban support tools, AI-assisted method analysis and reporting, and related exports.

We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of the plan you have selected. You may not reverse engineer the Service, resell or redistribute it, or circumvent technical or usage limits.

3. Your account

• You must provide accurate registration information and keep it up to date.
• You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in breach of applicable law;
• engage in fraud, spam, or misrepresentation;
• infringe the intellectual property or other rights of any third party;
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, or scraping data without permission;
• upload content you do not have the rights to use.

5. AI-generated output

Parts of the Service use artificial intelligence to generate analyses, recommendations and reports. You are responsible for the inputs you submit, for having the rights to those inputs, and for how you use the outputs. AI outputs may be inaccurate or incomplete and are provided for engineering decision support only — they are not a substitute for professional judgement, and should not be relied on without qualified human review. We may filter, restrict or refuse outputs, and remove content or suspend accounts where content is unlawful, infringing or abusive. Rights-holders may contact us at support@prodenhancer.com to report infringing content; repeat infringement will result in termination.

6. Your content

You retain ownership of the data and content you upload. You grant us a limited licence to host, process and display that content solely to provide and support the Service.

7. Intellectual property

ProdEnhancer retains all rights, title and interest in the Service, including its software, documentation, models, methodology and branding. Nothing in these Terms transfers ownership of our intellectual property to you.

8. Payments, subscriptions and taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, renewal, cancellation, tax and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically for the billing period you selected until cancelled. See our Refund Policy for details on refunds.

9. Service availability and warranties

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that results will meet any particular requirement. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access where there is a material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, you may request an export of your data within 30 days, after which it may be deleted.

11. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, production, data or goodwill. Our aggregate liability is limited to the fees you paid in the twelve months preceding the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

12. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes, assignment and force majeure

We may update these Terms; material changes will be notified through the Service or by email. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
